Terms of Service

Welcome to CLOUVEX. These Terms of Service ("Terms") govern your use of the

ANELE service, operated by CLOUVEX LLC ("CLOUVEX", "we"), a Florida limited

liability company, United States. By signing up or using the service, you

("Customer") accept these Terms and our Privacy Policy.

1.1 What the service is, and what it is not

ANELE is an AI-powered virtual receptionist for small businesses. The

service receives inbound calls only: the Customer forwards their

existing business phone number to the CLOUVEX number shown at sign-up.

Anele answers 24/7 in English and Spanish, takes messages and, depending on

the plan, books appointments and transfers calls to the Customer's phone.

What CLOUVEX does not do, stated plainly:

Your number stays yours, with your carrier. All you do is tell your

carrier to forward calls to our line. You turn that on and off yourself, at

any time, without asking us.

1.2 Not an emergency service

Anele does not replace 911 or any emergency service. In an emergency,

the caller must hang up and dial 911 directly. CLOUVEX does not guarantee

routing of emergency calls.

1.3 The forwarding is yours

Turning it on and off is the Customer's responsibility, because it happens

at their carrier and CLOUVEX has no access to that account. That means two

things:

1.4 Call notice, and what is kept from a call ⚙︎

On every call, Anele announces in its first sentence that the call

may be recorded. Florida is a two-party consent state: that notice is

not optional and not configurable, it is in the code and is prepended

to any greeting.

What is kept depends on who answers:

what remains is text: the message and the transcript.

service that does. Once the business has passed its monthly allowance,

the caller hears a greeting in Anele's voice **telling them it is

recording** and asking for name, number and reason. That recording is

transcribed — by ElevenLabs, see 2.3 — and **the audio is deleted as soon

as the transcript exists**: it is not retained. The message follows the

usual 90 days.

There is currently no customer-enabled audio storage feature. If one is

offered in the future, it will be announced in advance and, when active,

recordings will be kept for 90 days and then deleted automatically, like

everything else.

The Customer is responsible for complying with recording laws applicable to

their business and to the states they receive calls from.

1.5 The only two calls we place outbound

Transferring a call to a number you gave us, and calling you to read an

urgent message nobody has picked up.

We do not call your customers. We do not make sales calls. We do not use

your number for anything you did not ask for.

1.6 Plans

20 calls per month; from the 21st call, a voicemail in Anele's voice

records and transcribes the message. No appointments or transfers. **No

card required.** Includes messages by email (and Telegram if the Customer

sets it up) and a weekly email summary.

1.7 Payments, cancellation and refunds ⚙︎

There is no billing in place today: the free plan asks for no card and

the paid plans are not yet open to the public. What follows describes how

they will work and governs from the moment they open.

Paid plans will be charged monthly in advance through Stripe; CLOUVEX

does not store card numbers. Prices are those published on the website

at sign-up; price changes are announced at least 30 days in advance. The

Customer signs no contract and no lock-in: they may downgrade, move to

the free plan or cancel at any time from their account or by writing to

info@clouvexpbx.com; the month already paid runs to its end, with no

proration. The first paid invoice carries a 7-day full-refund guarantee.

On cancellation, the Customer removes the forwarding from their number

using their carrier's code (instructions at /help).

1.8 Acceptable use

The Customer represents that they have the right to forward the number they

register, that the information in their profile is accurate, and that they

will not use the service for illegal, fraudulent, harassing, impersonating

or spam purposes. The Customer is responsible for what Anele says on their

behalf according to their profile instructions. CLOUVEX may suspend the

service for misuse.

1.9 Availability and nature of the service

CLOUVEX will use reasonable efforts to keep the service available 24/7.

Absolute uptime is not guaranteed; maintenance or third-party interruptions

(carriers, providers) may occur. **Anele is an automated system: it may

mishear a name, a number or a reason.** The Customer should review their

messages and not rely on the service for critical decisions.

1.10 Limitation of liability

CLOUVEX is not liable for calls not answered or mishandled due to

third-party failures (the Customer's carrier, telephony, voice or

infrastructure providers, network outages) or force majeure, nor for

indirect damages, lost profits or loss of business. **CLOUVEX's total

liability to the Customer is limited to the amount paid by the Customer in

the last three months** (zero on the free plan). The service is provided

"as is" to the extent permitted by law.

1.11 Text messages (SMS)

Program name: CLOUVEX alerts.

If you consent — by ticking the corresponding box at sign-up — **CLOUVEX

LLC** may send text messages to the mobile number you give us. These

three, and no others:

that you are nearing your plan limit, or an incident that affects you;

These are not advertising. CLOUVEX does not send promotions by text

message, and does not pass your number to anyone else to do so.

Message frequency varies, because it depends on the calls you receive.

Message and data rates may apply.

Reply STOP to any message to opt out; it stops immediately. **Reply

HELP for help, or write to info@clouvexpbx.com**.

Consent is optional and is not a condition of service. If you do not

give it, sign-up completes just the same and your notifications arrive by

email. You may withdraw it at any time, and withdrawing it does not close

your account.

Handling of this data is governed by our Privacy Policy, in particular

section 2.3 (who we share it with) and 2.4 (text messages).

1.12 Governing law, changes and contact

These Terms are governed by the laws of the State of Florida, United

States, without regard to its conflict of law rules. Any dispute will be

resolved in the **state or federal courts located in Miami-Dade County,

Florida**, and the parties consent to that jurisdiction.

**There is no arbitration clause and no class-action waiver, and that is

deliberate:** a lawyer drafts that or it does not go in. A badly written

clause of that kind can be struck down entirely, which is worse than not

having it.

CLOUVEX may update these Terms with reasonable notice by email or on the

website; continued use after notice means acceptance. Contact:
